Terms & Conditions


The finer details

    1. These T&Cs contain the terms and conditions on which Taking Shape will provide the Rewards Program to Members
    2. These T&Cs apply to a Member's participation in all Promotional Activity, use of the Asset Card, redeeming Rewards Vouchers and loyalty transactions
    3. By joining the Rewards Program, Members agree to be bound by these T&Cs
    4. Taking Shape may make offers within the Rewards Program that are subject to additional conditions and those conditions will form part of these T&Cs and will prevail to the extent of any inconsistency
    5. Current T&Cs are available on the Website
    6. Subject to the Australian Consumer Law, Taking Shape may cancel, terminate, modify or suspend the Rewards Program, or vary the T&Cs at any time in its absolute discretion
    7. Decisions made by Taking Shape in relation to the Rewards Program are final
    1. Asset Card means a Rewards Program membership card linked to a Member's Reward Program account
    2. Asset Level means the membership level of a Member (Asset, Silver Asset, Gold Asset, Platinum Asset or Diamond Asset) as determined by the Member's Point Balance
    3. AUD means Australian Dollar(s)
    4. Australian Consumer Law means Schedule 2 of the Competition and Consumer Act 2010 (Cth)
    5. Australian Stores includes all Australian Taking Shape Boutiques and Taking Shape Myer Concept Stores and excludes Taking Shape Clearance or Factory Outlet Stores
    6. Birthday Voucher means a Rewards Voucher issued on or around a Member's birthday
    7. In Store means a transaction taking place in any Taking Shape Boutique, Taking Shape Myer Concept Store or Online at TakingShape.com
    8. Inappropriate Conduct includes (but is not limited to) conduct by a Member in relation to the Rewards Program that involves fraud, offensive or abusive conduct, inappropriate or unauthorised use of or access to information belonging to Taking Shape or another Member, failure to pay any monies owing, and/or a breach of these T&Cs
    9. Member means an individual whose application for Membership of the Rewards Program is accepted by Taking Shape, and whose Membership remains current
    10. Member Profile means the information linked to a Member's personal Rewards Program membership account
    11. NZD means New Zealand Dollar(s)
    12. Point means a point earned by a Member via participation in the Rewards Program
    13. Program Year means the period from 1 July to the following 30 June
    14. Promotional Activity includes: Any special offers, temporary price reductions or events that are undertaken In Store and/or Online.
    15. Rewards Voucher means a fixed value voucher able to be redeemed by a Member
    16. Rewards Program means the Taking Shape 'Celebrate Your Curves' Rewards Program
    17. T&Cs means these terms and conditions as updated or added to by Taking Shape
    18. Technical Issues means the technical malfunction of any telephone or telecommunications network, connection or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any website or intranet site (including the Website)
    19. Taking Shape means TS14 Plus Australia Pty Ltd ABN 69 032 764 154 or its authorised representatives
    20. Website means the website at www.ts14plus.com.au/cyc
    1. You may apply to be a Member by completing an application In Store (which may be at a store location or online at www.TakingShape.com)
    2. Membership is only open to individuals who provide their name, valid email address and contact phone number and reside in Australia or New Zealand
    3. If you become a Member, you will be issued with one Member Profile and one Asset Card, which are personal to the Member. Members are not permitted to apply for or use any other Member Profile or Asset Card. Members must not allow another person to use their Member Profile or Asset Card
    4. Taking Shape may terminate or suspend a Member Profile or Asset Card at any time if Taking Shape reasonably believes that a Member has engaged in Inappropriate Conduct
    5. Membership is personal to the Member and is not transferable
    6. Taking Shape employees cannot become Members whilst Taking Shape employs them
    7. Members may any time terminate their membership by providing written notice to Taking Shape at [email protected]
    1. Members are entitled to earn Points after they become a Member
    2. Members can earn Points in their Member Profile when they purchase Taking Shape full priced products or full priced products on temporary promotion In Store (including online). Points cannot be earned on clearance, reduced or sale products
    3. To earn points for online purchases made at www.TakingShape.com, a Member must make the purchase in their online shopping account and enter all the required Member information
    4. Points will not be issued for gift card purchases. Points will be issued when a Member redeems gift cards In Store
    5. Points will not be issued on the redemption of Rewards Vouchers or Birthday Vouchers
    6. 1 Point will be issued for each $1AUD or $1NZD that a Member spends or redeems on full priced products or full priced products on temporary promotion
    7. Taking Shape reserves the right to vary the method of allocation of Points at any time and without notice.
    8. All purchases of full priced products or full priced on temporary promotion products from www.TakingShape.com will earn Points as if the transaction was completed in AUD
    9. Each Member's Points balance will be reset to zero at the beginning of each Program Year
    10. Points cannot be awarded for purchases made by a Member before joining the Rewards Program
    11. Points earned may not appear in a Member Profile for up to 48 hours from the transaction time
    12. Members must check their Member Profile regularly to confirm that points are being credited properly
    13. Members must notify Taking Shape of any discrepancies in their Member Profile within three months from the relevant transaction. Taking Shape reserves the right to decline to make any amendments for discrepancies outside that period
    14. Points do not constitute any form of property or currency
    15. When placing a lay-by Points are earned for the full amount of the purchase on the day the lay-by is started. No points are earned on lay-by payments
    16. Points earned on the purchase of products that are subsequently returned for a full refund, will be deducted from the Member's Point balance
    1. Members are encouraged to use Asset Cards to record Points earned for their eligible purchases made In Store at physical store locations.
    2. New Members who apply at a physical store location will be issued an Asset Card. The Asset Card remains the property of Taking Shape at all times.
    3. Members who apply online at www.TakingShape.com will not receive an Asset Card but will be able to earn points and redeem Rewards Vouchers online.
    4. To activate an Asset Card, a Member must have a valid and unique email address.
    5. Only one Asset Card can be presented for each transaction.
    6. Members may be required to provide proof of identification at the point of purchase to verify their identity.
    7. Lost or stolen Assets Cards should be reported to Taking Shape, either In Store or through the Website. A replacement Asset Card will be issued, subject to verification of identity if required. A replacement fee may be applied for each re-issued Asset Card, at Taking Shape's sole discretion.
    1. There are five Asset Levels within the Rewards Program - Asset, Silver Asset, Gold Asset, Platinum Asset and Diamond Asset.
    2. Taking Shape will allocate Members to an Asset Level according to their current Points balance.
    3. Taking Shape reserves the right to change the Asset Level names, points balance allocations and benefits at its discretion and without notice.
    4. At the beginning of each Program Year, members will be allocated to the Asset Level that corresponds with the number of Points the Member earned in the previous Program Year (e.g. a Member in Gold Asset will remain at Gold Asset provided the Member has earned 750 to 1249 Points in the previous Program Year but if the Member has earned 250 to 749 Points, the Member will revert to Silver Asset).
    5. Taking Shape may upgrade or maintain a Member's Asset Level at its absolute discretion.
    1. Subject to the Member's entitlements, Taking Shape will issue Rewards Vouchers to a Member in the first full week of each month based on the Asset Level reached at the end of the previous month (e.g. Rewards Vouchers issued in the first week of April will be based on a Membership Status on 31st March). Rewards vouchers are issued via email to the email address provided upon joining the Rewards Program.
    2. Taking Shape may issue a Rewards Voucher based on a Member's Points balance.
    3. Taking Shape will notify the Member via email of the Member's Rewards Voucher entitlements.
    4. Rewards Vouchers cannot be sold, transferred or assigned to another party and are not redeemable for cash – including (but not limited to) gift vouchers, gift cards, cheques or credit cards.
    5. Rewards Vouchers cannot be used to make a payment on a Lay-By or JAM payments or in conjunction with PayPal.
    6. Rewards Vouchers will be issued in the currency of the Member's last transaction.
    7. Members will not earn Points on the redemption of Rewards Vouchers.
    8. Rewards Vouchers can only be redeemed for the purchase of full priced products.
    9. Rewards Vouchers cannot be redeemed to purchase full priced styles on temporary promotion, clearance, reduced or sale items.
    10. Rewards Vouchers issued in AUD can only be redeemed in Australian Stores or on www.TakingShape.com and cannot be redeemed in Taking Shape Clearance or Factory Outlet Stores or in any New Zealand Stores.
    11. Rewards Vouchers issued in NZD can only be redeemed in New Zealand Taking Shape Boutiques and cannot be redeemed in any New Zealand Taking Shape Clearance Stores, at www.TakingShape.com, or in any Australian Stores.
    12. Taking Shape may in its absolute discretion exclude certain items and promotions from being redeemed using Rewards Vouchers.
    13. A Taking Shape Team Member will process Rewards Vouchers redeemed in Taking Shape Myer Concept Stores. Myer Team Members are unable to process Rewards Vouchers.
    14. All Rewards Vouchers have a clearly marked expiry date.  Taking Shape will notify Members of the expiry date of each Rewards Voucher. 
    15. A Rewards Voucher may not be redeemed after the expiry date. Taking Shape reserves the right to extend the expiry date of any Rewards Voucher at any time without reason.
    16. Upon termination of a Membership, all Rewards Vouchers held by the Member will be void and unable to be redeemed.
    17. Taking Shape will not be held responsible or liable if a Rewards Voucher is not redeemable in the case of a Technical Issue but in that case, Taking Shape will use reasonable endeavours to rectify the error to ensure that the Rewards Voucher can be redeemed.
    18. Rewards can only be redeemed once. Rewards Vouchers used multiple times will be declined and the Taking Shape Customer Service Team will contact the Member to arrange an alternative payment or otherwise amend the Member's Points balance accordingly.
    19. Reward Vouchers must be redeemed in a single transaction. Change or credit notes will not be issued for any value unspent.
    20. Where items purchased with a Rewards Voucher are refunded in a Taking Shape Boutique or www.TakingShape.com the value of the Rewards Voucher will be returned as a credit note (unless otherwise required by law).
    21. Where items purchased with a Rewards Voucher in a Taking Shape Myer Concept Store are refunded, the value of the Rewards Voucher will be forfeited (unless otherwise required by law).
    22. A maximum of one Rewards Voucher per Asset Level, per Member, per Program Year will be issued.
    23. A Rewards Voucher is not legal tender in any country.
    24. Taking Shape is not responsible for any lost or stolen Rewards Vouchers and is not liable to replace any Rewards Voucher that is lost or stolen.
    1. Birthday Vouchers will be issued to an eligible Member, where possible, in the last week of the month prior to the Member’s birthday month (e.g. Birthday Vouchers for a Member's birthday in September will be issued in the last week in August). Birthday Vouchers are issued via email to the email address provided and will have a one-month expiry.
    2. To receive a Birthday Voucher, a Member must provide their birthday information at least one month prior to their birthday.
    3. Except as otherwise set out in this 'Birthday Vouchers' section, the terms and conditions for Rewards Vouchers apply to Birthday Vouchers.
    4. Birthday Vouchers are not retrospective and will not be issued for Birthdays that occurred prior to becoming a Member, or prior to completing and providing the required information.
    5. Birthday Voucher values are determined by the Member's Asset Level at the time of issue (not at the time of their birthday). 
    1. Member's personal information will be collected, used and stored for the purpose of conducting the Rewards Program or as otherwise stated at the point of collection or in the Taking Shape Privacy Policy.
    2. Members must ensure that their information is accurate and current.  Members must update their Membership Profile when their contact details change including but not limited to email address, phone number and mailing address. This can be done by signing into the Member Account at www.TakingShape.com
    3. Taking Shape will provide Members with their personal information on request, subject to reasonable verification requirements.
    4. Taking Shape may (but is not obliged to) provide Members with statements relating to their membership activity from time to time. 
    1. Where Taking Shape must give a Member notice of any matter concerning their Membership, Members agree that Taking Shape will be taken to have given the Member notice if Taking Shape sends the Member a communication (whether by email, post or otherwise) to the email or mailing address recorded in the relevant Member Profile.
    2. Members agree that email will satisfy any requirement for written communication. The Member will receive any electronic communication sent by Taking Shape on the next business day after Taking Shape sent it.
    3. Taking Shape will not accept any liability for any Technical Issues that may cause damage to any computer related to or used in connection with the Rewards Program or may cause any email communication to any Member to be misdirected, lost or not received
    1. Taking Shape does its best to provide current and accurate information but the currency of information may change from time to time and Taking Shape may need to correct statements and representations made about the Rewards Program or a Member Profile.
    2. To the maximum extent permitted by law, all conditions, rights, remedies, liabilities and other terms implied by law are excluded from these T&Cs and Taking Shape is not responsible to Members or anyone else for any loss arising out of the use of the Rewards Program. 
    3. Subject to the Australian Consumer Law, the Rewards Program is provided on an "as is" basis without warranties of any kind, either express or implied and Taking Shape makes no warranties or representations as to the operation of the Rewards Program.  To the extent liability cannot be excluded, any liability incurred by Taking Shape in relation to a Member's use of the Rewards Program is limited to the maximum extent provided for by the Australian Consumer Law. Nothing in these Terms and Conditions limits your rights under the Australian Consumer Law.
    4. Taking Shape will not be liable for any tax liability incurred by a Member in connection with the Rewards Program, including that incurred in the provision of Rewards Vouchers.
    1. Taking Shape does its best to provide current and accurate information but the currency of information may change from time to time and Taking Shape may need to correct statements and representations made about the Rewards Program or a Member Profile.
    2. To the maximum extent permitted by law, all conditions, rights, remedies, liabilities and other terms implied by law are excluded from these T&Cs and Taking Shape is not responsible to Members or anyone else for any loss arising out of the use of the Rewards Program.
